GreenGo respects intellectual property and responds to clear notices of alleged infringement under the Digital Millennium Copyright Act, 17 U.S.C. §512 ("DMCA").
1. Designated agent
Copyright Agent, GreenGo Partners LLC, 1515 Surf Ave, Brooklyn, NY 11224 · info@greengopartners.com · +1 (929) 969-5699. Our agent is registered with the U.S. Copyright Office. The fastest route is the form at greengopartners.com/legal/dmca.
2. Sending a takedown notice
Your notice must include:
- Your physical or electronic signature, as the owner or someone authorized to act for the owner.
- Identification of the copyrighted work, or a representative list if several works are involved.
- The listing URL or other information precise enough for us to find the material.
- Your name, address, phone number and email.
- A statement that you have a good-faith belief that the use is not authorized by the owner, its agent or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner or authorized to act for the owner.
Before sending a notice, consider whether the use may be fair use or licensed, for example under an open-source license. Under §512(f), anyone who knowingly misrepresents that material is infringing can be liable for damages.
3. What happens next
- We remove or disable access to the material promptly, normally within 2 business days of a complete notice.
- We notify the seller or user and send them a copy of the notice, with personal contact details redacted where the law allows.
- Payouts for sales of the affected listing may be held under the Seller Agreement while the matter is open.
4. Counter-notice
If you believe your material was removed by mistake or misidentification, send a counter-notice to our agent with:
- Your physical or electronic signature.
- Identification of the material and where it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification.
- Your name, address and phone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if you are outside the U.S., any judicial district in which GreenGo may be found), and that you will accept service of process from the person who sent the notice or their agent.
We forward the counter-notice to the complainant. Unless the complainant tells us within 10 business days that they have filed a court action, we restore the material within 10 to 14 business days after receiving the counter-notice.
5. Repeat infringers
We track valid notices against each account. An account that receives three valid notices in any 12 months that were not successfully countered is terminated, and we may terminate sooner for clear or willful infringement. Terminated users may not open new accounts.
6. Trademarks and other rights
The DMCA covers copyright only. For trademark, patent, trade-secret, publicity or other claims, email info@greengopartners.com with your rights, the listing, and the basis for your claim. We review these claims and may remove material, ask the seller to respond or tell you that we cannot judge the dispute.
7. Sellers: open-source and AI-generated work
Sellers must follow the licenses of any open-source code or assets they include, and keep the required notices in the product. Sellers are responsible for their rights in AI-generated output, including the terms of the AI tools they used.
